E-invoicing in Spain: what is mandatory and when
There are two separate obligations. Verifactu requires the use of certified invoicing software that records every invoice and can send it to the Spanish Tax Agency (AEAT): it will be mandatory from 1 January 2027 for companies and from 1 July 2027 for self-employed professionals and all other taxpayers. Business-to-business e-invoicing (the Crea y Crece Act, implemented by Royal Decree 238/2026) will be introduced in two phases, whose final timetable depends on a Ministerial Order that has not yet been published.
Frequently asked questions about e-invoicing
Is e-invoicing already mandatory?
Not yet for most businesses. Verifactu will become mandatory in 2027, and business-to-business e-invoicing will come into force in phases following the Ministerial Order implementing Royal Decree 238/2026. Adapting early helps you avoid last-minute rushes and mistakes.
When does Verifactu become mandatory?
From 1 January 2027 for Corporate Income Tax payers and from 1 July 2027 for everyone else, including the self-employed. These dates were set by Royal Decree-law 15/2025, which postponed the original timetable by one year.
When will business-to-business e-invoicing become mandatory?
Royal Decree 238/2026 (Official State Gazette, BOE, of 31 March 2026) sets out two phases: 12 months after the date set by the Ministerial Order for companies with a turnover of more than €8 million, and 24 months for all other companies and self-employed professionals. Until that Order is published in the BOE, there is no final date.
Does it affect self-employed professionals and SMEs in the Canary Islands?
Yes. Verifactu and B2B e-invoicing apply in the Canary Islands in the same way as in the rest of Spain, even though invoices carry IGIC (the Canary Islands General Indirect Tax) instead of VAT. Only the Basque Country and Navarre, with their own regional tax regimes, have separate systems.
What happens if I do not adapt?
The General Tax Act (Article 201 bis) provides for fines of up to €50,000 per financial year for using invoicing systems that do not meet the required standards.
