Data processing as a Data Processor:

In the course of providing its services, Akrolih Tu Guía Online S.L. may access the data of prospective clients, clients, employees, website users and other data subjects of other companies. These data will be processed solely for the provision of those services and will not be used for any other purpose.

As Data Processors, we undertake to process personal data in accordance with the instructions of the Data Controller company (our client) and with the provisions of the General Data Protection Regulation (GDPR). The personal data we process will only be used to provide the services and will be handled confidentially and securely, guaranteeing the protection of data subjects’ rights.

As a result of your relationship with us, we may process different categories of personal data, always depending on the service or product you have contracted with us. These data may be collected through any of the channels offered by Akrolih Tu Guía Online S.L., both online and in person. The categories of data processed may include:

• Corporate data of partner organisations and contact details of their representatives or contacts.

Akrolih Tu Guía Online S.L. informs you that it may process personal data for the purposes indicated below, provided there is a legal basis for each processing activity.

The GDPR and the LOPDGDD establish that a person’s information (their “personal data”) may only be processed if one of the legal bases expressly provided for in those regulations applies. More specifically, Article 6 of the GDPR sets out an exhaustive list of the legal bases that may justify and legitimise the processing of personal data:

• Contractual relationship.
• Vital interests of the data subject or of other persons.
• Compliance with a legal obligation of the controller.
• Public interest or exercise of official authority.
• Overriding legitimate interest of the controller or of the third parties to whom the data are disclosed.

In some cases, Akrolih Tu Guía Online S.L. will process your data on the basis of the legitimate interest provided for in Article 6(1)(f) of the GDPR, as it considers that such processing does not harm clients’ right to the protection of their personal data. The main purposes for which your personal data may be used, and the legal basis for each processing activity, are as follows:

Purpose: compliance with accounting, legal, tax and administrative obligations.

Purpose: To prepare personalised quotes for you, provide the services requested and invoice for them.

Legal basis: Pre-contractual and/or contractual performance.

Purpose: To collect and process the data needed to apply for and manage public grants under the Kit Digital programme on behalf of the partner.

Legal basis: Performance of a contract or application of pre-contractual measures with the partner, and compliance with legal obligations applicable to the beneficiary (partner) of the grant programme.

Purpose: Capture, management, reproduction and/or publication of audiovisual files (photographs, videos, etc.) showing individuals on websites, social media, printed publications or any other medium.

Legal basis: Your consent.

Purpose: Management of your participation in competitions, prize draws and other activities in which you have asked to take part.

Purpose: In order to assess users’ level of satisfaction with the products and/or services contracted, Akrolih Tu Guía Online S.L. will send quality surveys to obtain your opinion on them and thus continuously improve its services.

Purpose: In order to offer users products and services that may be of interest to them, we will send offers on products and services related to those currently or previously contracted with Akrolih Tu Guía Online S.L. You can object to receiving these communications in each communication you receive.

When a registered user sends us an enquiry, request or suggestion, we use their data to respond on the basis of the performance of the contract. If you submit a request to exercise the rights explained in section 6, RIGHTS YOU CAN EXERCISE, we will use your data on the basis of a legal obligation.

Purpose: To include it in current recruitment processes or in future processes for which the candidate may be suitable; it may not be used for any other purpose.

Legal basis: Application of pre-contractual measures.

By providing your data through any of the channels available, you guarantee that the data provided are accurate and undertake to notify us of any changes to them.

Please remember that when we ask you to fill in your personal data to give you access to a feature or service, we will mark some fields as mandatory, as we need those data to provide the service in question. Please note that if you decide not to provide us with those data, you may not be able to use those services or features or send us your request.

The personal data provided will be kept for as long as necessary to fulfil the purpose for which they were collected. Once this period has ended, we will keep your data duly stored and protected for the statutory limitation periods required. Once any possible legal actions in each case have become time-barred, we will delete the personal data.

To fulfil the purposes set out in this Privacy Policy, we need to give access to your personal data to organisations that support us in the services we offer you, namely:

• Business advisory firms
• The Spanish Tax Agency

Apart from those listed, Akrolih Tu Guía Online S.L. will not transfer personal data to third parties, except where required by law. You can exercise any of the rights explained below simply by telling us the reason for your request and the right you wish to exercise. If we consider it necessary in order to identify you, we may ask you for a copy of a document proving your identity.

Akrolih Tu Guía Online S.L. must respond to the request within one month of receiving it. This period may be extended by a further two months where necessary, taking into account the complexity and number of requests.

You have the right to withdraw your consent at any time by sending an email to [email protected]. Withdrawal of consent will not affect the lawfulness of processing carried out before consent was withdrawn.

If you consider that your right to the protection of your personal data has been infringed, you may lodge a complaint with the Spanish Data Protection Agency (AEPD), www.aepd.es.

There may be occasions when you provide us with data belonging to third parties, for example, contact persons. If you provide us with Personal Data of third parties, you guarantee that you have informed them of the purposes for which and the way in which we need to process their personal data.

If a third party has provided us with your data, we will process them within the purposes set out in this Privacy Policy.

Akrolih Tu Guía Online S.L. guarantees the adoption of appropriate measures to ensure the confidential processing of your data, given their confidential nature, undertakes to keep such data secret and to treat them with the utmost discretion, and declares that it has implemented in its information system the security policies corresponding to the type of data handled, in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

All data provided through our platform is collected using a secure protocol.

We may amend the information contained in this Privacy Policy whenever we consider it appropriate, for example to comply with changes in legislation or case law.
